FAQ’s

Q: I’ve started advertising in a magazine and we’ve had a complaint, what do I do now?

A: In Australia all advertisements (including but not limited to magazines, print, social media, labels) need to be compliant with the TGA Advertising Code.

We understand that marketing is crucial to the success of all products and complying with the regulations is often simple to manage with the right guidance. Many types of advertising require approvals from relevant government departments before they go live to ensure images, copy and even in some cases, concepts, are in accordance with the regulations. Being proactive in this area can save you time and money, especially before you go to market.

But it’s not just advertising that is covered by these rules, anything that includes product specific information also needs to be compliant with the appropriate regulations, including newsletters, manuals, articles, blogs or videos. Reach out with your query, we can help.

Q: My manufacturer has approved our formulation, is this enough?

A: The requirement to prove that your product meets all guidelines falls to you, not your manufacturer, so it’s best to ensure that all formulations are evaluated by an independent auditor or regulatory consultant.

Q: What is the Classification of my product?

A: It can depend on a variety of factors from your ingredients to your claims and indications to product presentation (ie, tablet, liquid, powder). Remember, its not always the same as other countries. Get in touch, we can help.

Q: I am importing a dietary supplement from the US to Australia, it has FDA approval and we have a free trade agreement with America, what guidelines do I need to follow?

A: Your product needs to meet the regulatory requirements of the market that it will be sold in, therefore if you are importing a US product to the Australian market, even if it is FDA approved, you still need to ensure that the products comply with Australian regulations.
